media mount software product means any software product developed by media mount and includes Order History Software and Mal's E-Commerce Scripts and all other media mount software.

Access to and use of the media mount software product constitutes acceptance of the following terms and conditions. media mount may update or change these terms at any time. It is the responsibility of the user to revisit the terms periodically, as the user is bound by the terms listed on this page. No venture or partnership between the user and media mount is formed by this agreement, the user of the mediamount.co.uk or orderhistorysoftware.com web sites, or the user of the media mount software product.

Warranties: All materials provided in the media mount software product are presented with the belief that they are in good working order, and that the structure is valid. However, media mount will not guarantee the completeness or functionality of any page or structure in the download or installation of data into another system. The media mount software product is provided by media mount "as is" and "with all faults". No warranties or guarantees are provided for the media mount software product.

Exemption: the media mount software product 'Order History Software' will not receive orders directly from Mal's Shopping Cart system via Remote Http Link from certain payment providers. Please view this link for a full list at Mal's E-Commerce website.

Any payment gateway that does not return the customer to Mal's Cart Confirmation Order screen will not send orders directly to the 'Order History Software' product.

However, orders can be uploaded to Order History Software via a .csv file or manually entered. This information is stored in Mal's Cart Admin screen for Premium Cart users and order information can be downloaded as a .csv file. Note: this information does not have the correct format to upload directly into the media mount software product 'Order History Software'. Several changes will need to be made to this .csv file for it to be uploaded successfully.

Liability: The user agrees to indemnify and hold media mount harmless without exception or limitation from all liability, expenses, claims, action, fees, losses or damages caused by the direct or indirect use of the media mount software product at any time and by any party. In no way will media mount be held liable for any use of the software product by the user or by third parties. You agree that you as the person legally responsible for use of this account, are at least 18 years of age. You agree to supply media mount with a current and truthful name, postal address, email address and telephone number for our records, and you have a continued obligation to keep this information current.

Responsibilities: The user accepts all responsibilities for the use of the media mount software product. media mount will not be held responsible for any inappropriate use of a web site or company policies from a company or individual using the media mount software product.

Costs: Each media mount software product can be purchased for a specified time span and is governed by a media mount license. media mount reserves the right to change a license price at any time. If the user has purchased a license before a price change takes effect, they will not be required to pay the new license fee until the license has expired. media mount is not required to contact users regarding a price change but may do so via email.

Payment: The user agrees to supply appropriate payment in advance for the media mount software product, in accordance with invoices received via email from media mount. The user understands that failure to supply such payment in accordance with the instructions contained in the invoice will result in account suspension. The user understands that media mount at its sole discretion has the right to refuse to reinstate a suspended account regardless of subsequent payment attempts by you. Further, The user understands that there may be fees associated with reinstatement of a suspended account.

The user understands that invoices for the media mount software product are sent out via email only, and that it is your responsibility to maintain working email addresses in your account configuration. You understand that your failure to receive these invoices for any reason does not alleviate your responsibility to keep your account current.

The user agrees that all license fees are non-refundable and understands the need to choose the license period carefully to meet their needs.

Customization: The media mount 'Order History Software' product is installed on the media mount web server as-is (unless a separate license is purchased) and does not include any customization to the product layout, nor does it include additions or modifications of fields. The user may customize some information within the media mount software product where it allows. The user will not hold media mount responsible for any damages caused by the user's customization of the media mount software product, nor will they expect media mount to fix problems that arise from any customization.

Support: media mount provides online support for the media mount software product via a support help section on the Order History Software web site (http://www.orderhistorysoftware.com/contact.asp).

Discontinuation: media mount reserves the right to discontinue distributing the media mount software product license to any party for any reason at any time. media mount is not responsible for contacting users for this discontinuation. The media mount software product will not be provided to companies known to be selling illegal items or services, nor will it be provided to individuals known to be under 18 years of age. The media mount software product will also be revoked from any company using inappropriate methods of promotion, such as spamming email addresses.

Data Backup: In no way will media mount be responsible for the loss or destruction of any parts of the information entered into the media mount software product by the user, either via upload/download of data or download via Mal's Remote Http link function. A frequent backup of all information from the media mount software product (where appropriate) should be made by the user. In the case of media mount web server failure or network traffic failure, media mount are not liable for any loss of information being appended or updated to the media mount software product database.

Security: media mount software products are administered via a username/password system. A SSL secure connection is not used to validate or process any data coming to or from the media mount software product. No confidential information should be collected, stored or processed via the media mount software product. All data is kept in a secure database within the United Kingdom and is accessible to media mount purely for data purity checks. No other party except the rightful user has access to their data and records at any time. All usernames and password that are given to the rightful user are done so in a secure a way as possible and are held in the secure database. You agree to indemnify and hold media mount harmless from and against any data loss or damage due to your negligence from either distributing usernames and passwords to a third party or deleting or damaging the data yourself.

Misc: This website is controlled and operated by media mount from its offices in Bangor, Northern Ireland. This Agreement shall be construed in accordance with the laws of the United Kingdom, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the courts of the United Kingdom.

Privacy Policy: media mount never rents, sells or trades any information obtained through the registration of the media mount software product, and will use the email information only for communications regarding media mount software product updates.

Privacy Statement: I consider all information and data relating to both users and their customers to be absolutely confidential. In practice that means I do not under any circumstances release the URLs of websites or email addresses of users or their customers to third parties including other users. Customer data is not analyzed or used or maintained for or in any form of statistical record of any kind.
